The Homeowners Association (HOA) assessment pays to maintain our Common Areas and is due on July 1 annually.
The HOA Declaration of Covenants, Conditions, Easements, and Restrictions (CCERs) is recorded against each Lot. Every Lot is legally bound to our homeowners association. Our HOA is incorporated as a nonprofit under our corporate name, Highland Heights First Association. We operate under the Assumed Name Highland Village Homeowners Association.
No Owner may waive or otherwise escape liability for the assessment provided for in the Bylaws, Articles of Incorporation, or Declaration of Covenants, Easements, and Restrictions by non-use of the Common Area or abandonment of his or her Lot.
All Lots within the Highland Village subdivision are subject to the Articles of Incorporation, Bylaws, Declaration of Covenants, Conditions, Easements & Restrictions (CCERs), and the Architectural Guidelines for Highland Village. These documents impose restrictions about how Highland Village Lots are used or altered, and how the Association operates. Ensure the Association Assessments are current before you purchase a Highland Village Lot.
Your seller should provide you with a Resale Disclosure Certificate (RDC) from our association provides details about the association, verifies the status of assessments against the Lot, and identifies any covenant violations. The RDC includes copies of all Association documents.
Properties with unpaid assessments, in cases other than foreclosure, or with a lien against the property will become the responsibility of the new Lot owner if they are not settled prior to closing. Liens are filed against the Lot.
Annual assessments are mailed to Lot owners in late May. The Board of Directors may raise the annual assessment fee by an amount up to 10% without approval of the membership. Assessments are due July 1. Delinquent assessments accrue interest at the rate of eight percent (8%) per annum. Lot owners whose assessments are past due shall lose their voting privileges until their account is current. The Association may bring action at law against any Owner personally obligated to pay the assessments, and any penalties.
